These Terms of Service govern your access to and use of the brandybee.ai website and the BrandyBee platform.
By creating an account, accessing the Services, or continuing to use BrandyBee, you agree to be bound by these Terms.
Please read these Terms carefully before using the Services.
Subject to these Terms and any applicable subscription, BrandyBee grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your internal business purposes.
We may update, improve, suspend, or discontinue parts of the Services from time to time.
You must use BrandyBee in compliance with applicable law and in a manner consistent with these Terms.
You retain your rights in the Input you provide to BrandyBee.
You grant us a limited right to process, store, analyze, and use that Input only to provide the Services, operate the product, and produce anonymized and aggregated statistics.
If you connect Facebook, Instagram, Meta ad accounts, or other third-party platforms, you grant BrandyBee a limited, non-exclusive, worldwide, royalty-free license to host, store, format, transmit, and publish content you authorize us to publish on your behalf, solely to provide the Services.
Subject to these Terms, BrandyBee does not claim ownership over Output created specifically for you. You remain responsible for reviewing and approving any output before use.
When you submit a store URL or related brand information, BrandyBee may analyze publicly available content associated with that input.
BrandyBee and all related software, interfaces, designs, logos, documentation, and service materials are owned by or licensed to BrandyBee and protected by applicable intellectual property laws.
You may not use BrandyBee trademarks or brand elements without prior written permission.
Certain parts of the Services may require a paid subscription.
If you subscribe to a paid plan, you authorize us or our payment processor to charge the applicable fees.
Unless otherwise stated, subscriptions renew automatically at the end of each billing cycle until canceled.
To enable these automatic renewals, your payment method is securely stored by our payment processor (Stripe) and charged at each renewal until you cancel. We do not store your full card number on our own servers.
You can cancel a paid subscription at any time through the available account or billing tools. Cancellation stops future renewal charges.
We may change subscription prices. If we do, we will give you at least 30 days’ advance notice by email to the address on your account. A new price never applies to a billing period you have already paid for: it takes effect at your first renewal that falls on or after the date stated in that notice.
You can cancel at any time before that renewal and you will not be charged the new price. If you do not cancel and your subscription renews on or after the effective date, the new price applies from that renewal onward.
Refunds are governed by our Refund Policy, which gives you a 14-day window to cancel and receive a refund of the unused portion of your plan. Please see the Refund Policy for full details.
BrandyBee may connect with third-party services such as Meta, Shopify, WooCommerce, Google, or authentication providers. Your use of those services is governed by their own terms and policies.
When you connect a Facebook Page, Instagram account, or Meta ad account to BrandyBee, you agree to use BrandyBee in compliance with Meta Platform Terms, Meta Developer Policies, Meta Community Standards, Meta Advertising Standards, Meta Branded Content Policies, and Instagram Community Guidelines.
You may disconnect any Meta account at any time in BrandyBee under Settings → Integrations, or by removing BrandyBee from your Facebook account under Settings → Apps and Websites. When you disconnect, BrandyBee will stop accessing that account and will delete related access tokens and Meta-provided data within 30 days, as described in our Privacy Policy.
BrandyBee depends on Meta APIs and platform availability. We cannot guarantee that Meta APIs, permissions, rate limits, content review decisions, analytics, or publishing functionality will remain available or behave consistently.
Each party will protect the other party’s confidential information using reasonable care and will disclose it only where necessary to perform obligations under these Terms or where required by law.
To the maximum extent permitted by law, the Services are provided on an as-is and as-available basis, without warranties of any kind.
To the maximum extent permitted by law, BrandyBee will not be liable for indirect, incidental, consequential, exemplary, or punitive damages, including loss of profits, data, or business opportunity.
Our total aggregate liability for claims arising out of or related to the Services will not exceed the greater of the amount you paid to us in the six months preceding the claim or 100 USD.
You agree to indemnify and hold BrandyBee harmless from claims, losses, liabilities, costs, and expenses arising from your use of the Services, your breach of these Terms, your Input, your use of Output, content you publish through BrandyBee, or your violation of Meta Platform Terms, Developer Policies, Community Standards, Advertising Standards, Branded Content Policies, or other third-party platform rules.
These Terms, and any dispute arising out of or relating to them or the Services, are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles.
Before initiating formal legal proceedings, the parties agree to first attempt to resolve any dispute in good faith through direct communication.
If no resolution is reached, the parties submit to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware, and waive any objection to venue in those courts.
Nothing in this section deprives you, as a consumer, of the protection of the mandatory consumer-protection laws of your country of residence. If you reside in the European Union, the United Kingdom, or Türkiye, you retain the rights granted to you under the mandatory laws of your jurisdiction and may bring proceedings in your local courts where those laws so require.
We may update these Terms from time to time. Where changes are material, we will update the effective date and provide notice where appropriate.
